InterCard Account Terms and conditions

On the main section of this page you will find the Terms and Conditions, which shall apply, to your use of Premium content Services.

By using the Service You agree to be bound by the Conditions, which shall form a legal agreement between us. You also agree to be bound by the general web site terms and conditions and privacy statement to be found on www.thenetgate.org web site. If You do not agree to be bound by the Conditions, You may not register to and/or use the Service References to "we" or "us" in these Conditions shall be read as references to Gulhmes LTD.

  1. Definitions

"Service" means NetGate services, which protects your privacy during you Internet access. It includes the other services, which are highlighted in the home page, which can only be accessed after purchase of a pre paid card or during the trial period.

"Website Terms and Conditions" means the terms and conditions applicable to the use of the Web site at www.thenetgate.org

"You/Your" means you, the User of the Service.

"User" means a visitor to www.thenetgate.org or NetGate services, a registered user to the Service (where you have registered your personal details with us and have access to the Registration Areas.

  1. Use of the Service

2.1 You shall be responsible for installing & configuring the necessary software “NetGate Client” to Access the NetGate service. We provide the software for down load for free. We shall have no responsibility for the operation of any other software

2.2 Your access to the Service is by user account number and password. Your password is secret and personal to You and must not be disclosed to any third party in any circumstances. You are responsible for keeping Your password secure and confidential. You must take all precautions to prevent it being used by anyone else

2.3 If You do disclose or share Your user account number or password with another person or allow another person to access the Service on Your behalf, You agree to indemnify us for any losses or damages incurred by us as a result of Your actions. If we reasonably believe that the user account number and password are being used in any way which is not permitted by us we reserve the right to cancel access rights immediately without notice, and to block access to all users accessing through that account

2.4 You may change Your password at any time via the My Profile section of the Service. Should You become aware that another person knows Your password You should immediately change it. You must not store Your password on your PC

2.5 When accessing and using the Service You shall comply with all applicable laws and regulations in the country from which You access the Service

  1. Purchase of InterCard (Pre Paid) card

3.1 The InterCard card Fee payable by You is as set out on the Offer Pages as at the date You pay for the total face value of the card. Our Secure payment gateway agent will process the relevant fee(s) against Your MasterCard or Visa credit card number provided in your payment application

3.2 We may change our service fees at any time by giving you notice of at least one calendar month Any increases in the price of Your service will be notified to You by e-mail and this will also be reflected on the service web site

3.3 We are presently using more than one secured third party payment gateway like (CashU, PayPal), who are responsible for all transactions payments for InterCard

4.1 We reserve the right to alter without notice the Service features

4.2 We will offer you additional services as part of our services, If the addition of these services involves an increase in service fees you will be notified in accordance with clauses 3.2

  1. Our Liability

5.1 Any material downloaded or otherwise obtained by You through the Service is done at Your own risk and on the basis that You will be solely responsible for any damage to Your computer system or loss of data that results from any such activity

5.2 We will endeavor to provide the Service using all reasonable care. Except as required by law, we will not be responsible or liable for the fitness for a particular purpose of the Service or for any other loss or damage that You or any third party may suffer as a result of using or in connection with Your use of, or inability to use, the Service. We do not promise that the Service will operate without interruption or delay or will be error free, free of viruses or bugs or compatible with any other software or material

  1. Copyright and Trademark

6.1 All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the Service shall remain at all times vested in us or, where applicable, our service partners. You are permitted to use this material or content only as expressly authorized in writing by us. You will not assist or facilitate any third party to, copy, reproduce, transmit, distribute, frame, commercially exploit or create derivative works of such material or content or in any way infringe intellectual property or other rights pertaining to such material or content

7.1 You can terminate Your registration at any time by giving us notice by e-mail to support@thenetgate.org or support@gulhmes.com

7.2 Any un-used pre paid credit in your account will not be refunded if you terminate your account.

7.3 We shall be entitled to suspend or terminate Your access to any part of the Service at any time should You breach these Conditions, in the general Service Terms and Conditions and privacy statement to be found on www.thenetgate.org , or the terms and conditions of any offer you may have selected

7.4 We may, at our own discretion, terminate Your Pre paid account upon giving You one month's notice by e-mail

8.1 Where You are asked to input certain personal information about Yourself in order for Us to provide the Registration to You, You are responsible for the accuracy and truthfulness of such information and You warrant and undertake to us that all such information is true and correct. We will not use the information You provide to Us for any purpose, other than as stated on pre paid console section

8.2 We reserve the right to request supporting documentation to verify personal information in our absolute discretion

8.3 You must notify us immediately by e-mail to support@thenetgate.org or support@gulhmes.com of any change in Your personal details or if You wish to withdraw Your consent to Our using Your User Information for the stated purposes

9.1 We may change these Terms and Conditions on one month's notice. You will be notified of any changes by e-mail and via the terms and conditions page on the Service. Your continued use of the Service will constitute acceptance of such changes
